What this covers
This text applies to downloading, installing and running the Catering POS client installer offered on this page. It is not a sale of hardware, not a cash-register authorisation, and it does not replace the separate terms of a plugin or of a third party. If a button on this page is only a placeholder and does not provide a usable installer, this text does not treat that file as a released version.
Who the provider is
The provider is the operator identified on the current About page of this site. Registry details and contact information stay on that page and are not repeated here.
Software usage fee
For that download and for the copy installed from it, the pricing page wording at the time of download governs the software usage fee, any minimum term, any renewal fee and any refund of the software usage fee for the core hospitality functions. When this agreement version is published, that page states that the software usage fee for these core functions is 0 HUF, that no minimum term applies, and that no renewal fee applies; because no software usage fee is charged, no refund of such a fee arises. A zero fee does not transfer ownership, source code, or a right to resell the installer. If that pricing page wording later changes but the software usage fee stays zero, the change applies only to a new download made after the change. If the fee for a new download is no longer zero, this agreement version does not apply to that download. Plugins, third-party services and hardware are outside this scope and follow their own terms. Third-party components in the installer remain under their own licences.
The licence you receive
You receive a non-exclusive, non-transferable right to download the installer offered on this page while this agreement version remains published, and a right to install and run the copy you download in your own hospitality operation, including your own sites. You may not rent, sell or sublicense the software, remove legal notices, or offer the software itself as a service to others.
A copy that is already installed may continue to be used under the agreement version you accepted. The provider may stop offering new downloads on this page. You must stop using an installed copy only if you break this text, if you use the software unlawfully, or if the law requires you to stop.
Reverse engineering is allowed only to the extent that EU or Hungarian law makes it mandatory, including the extent required for interoperability under Directive 2009/24/EC.
What the software does not promise
Catering POS is hospitality business software. By itself it does not turn a till into an authorised e-cash register, and it does not take over your duty to check NTAK, invoicing and tax obligations against official sources.
Your responsibilities
You choose the computer, the operating system, the backups, and whether business data stays on your own equipment or on a server you select. You keep your own copies of business data. You may not use the software for unlawful processing.
Data
This download does not ask you to create an account. This text is not a privacy notice. Personal data on the website follows the published privacy text when that page is available. The provider does not undertake to keep that hospitality operation's business data.
Warranty
Except for rights that the law does not allow to be excluded, the installer and the software are provided as they are offered on this page. There is no promise of uninterrupted or error-free operation, and no promise of a particular tax or administrative result. The installer on this page may be replaced. A timetable for updates is promised only where the law requires one.
Liability
Nothing in this text limits liability for intent, gross negligence, fraud, or death or personal injury caused by negligence, or any other liability that Hungarian or EU law does not allow to be limited.
If the software usage fee that applies to that download is zero, there is, to the extent the law allows, no further liability for loss that is caused, including lost profit, lost revenue, lost data, business interruption and fines, together with tax and NTAK consequences. If a mandatory rule still requires liability for digital content supplied without a fee, that rule prevails and this paragraph yields to that extent.
A person who downloads for their hospitality activity contracts in the course of that activity, not as a consumer. If you act as a consumer and not in that activity, mandatory consumer rights in your country of residence remain. This text does not remove them.
Acceptance and version
Tick the checkbox and choose accept on this agreement version, and you accept this text. While this agreement version stays published, you may on that basis download the installer offered on this page. You may install and run the copy you obtain under the licence above. The version shown in the window is the agreement version, not the software version. When the text changes, a new agreement version is published and must be accepted again before the next download. Continuing to use a copy that is already installed is not, by itself, acceptance of a new agreement version. That copy stays under the version you accepted, including liability arising from it. If you accept this text for a business, you confirm that you are entitled to do so for that business.
Law and language
Hungarian law governs, without removing a consumer's mandatory right to bring a claim in the courts of their residence where EU law requires that. If the Hungarian, Chinese and English texts differ, the Hungarian text prevails. If one provision cannot be applied, the other provisions remain in effect.
Changes
The text is changed by publishing a new version on this page. Once the new version is published, the previous version no longer applies to new downloads.
